Terms and Conditions
POLICY
It has always been Pivotal Education's policy to treat our clients as our most valuable asset. You should note that your statutory rights under the current consumer protection laws are not affected (more probably enhanced).
DATA AND PRIVACY
We shall treat any personal information you provide to us as confidential. We use your personal information only for processing your orders and, if you consent, to notify you of courses, new publications and news relating to Pivotal Education which may be of interest to you. There are no circumstances under which this information might be passed to a third party.
SUPPLY
We undertake to supply you with the services, merchandise, schemes of work and courses described on our website. If we are delivering on-site training, there will always be a plan that is mutually agreed prior to the event, and we will execute the training according to this plan. Requests for Tips, Samples and Schemes of Work will usually be dispatched by email within 48 hours. Merchandise orders will be dispatched within seven working days within UK (usually sooner).
GUARANTEE
In the light of the foregoing you will appreciate we feel confident that we can unequivocally guarantee your total satisfaction with our products and service. Again you should note that your statutory rights under the current consumer protection laws are not affected.
PAYMENT, POSTPONEMENT AND CANCELLATION
- All payments are due within 14 days from the date of invoice.
- Payment may be made online using Paypal; by cheque; by BACS (direct bank transfer). For further details, please visit our website www.pivotaleducation.com Please note that some of our products/services attract VAT. This will be clearly stated on your invoice.
- In the event of non-payment, a second invoice will be issued after 2 months from the original with 5% surcharge added.
- Cancellation of bookings for INSET:
- More than 2 months prior to the date = 90% refund
- 2 months to 1 month = 50% refund
- Less than 1 month = Payment in full due
Postponement
If it is more than two months before the training day and you wish to move the date you can do so without charge. For postponement requests that are between 2 months and 1 month before the training date the charge will be 15% of the training fee plus any travel or accommodation costs that are not recoverable. It is not possible to postpone training less than one month before the agreed date.
STRIKE ACTION
If the day that you have booked is likely to be affected by strike action we will allow emergency postponement of the day if:
- More than 50% of the delegates have been told by the Union not to attend, and
- You inform Ellie Dix more than 48 hours before the day, and
- The strike action is legal and endorsed by the relevant union, and
- The invoice is paid as issued
In the event of postponement due to strike action we reserve the right to substitute the trainer and move the date to a mutually convenient date.
SEVERE ADVERSE WEATHER
If the training day you have booked is affected by snow, then we will allow emergency postponement of the day if:
- You inform Ellie Dix at least 24 hours before the training is due to start, and
- The institution (e.g. school/college) is closed or if staff turnout is expected to be less than 50% of normal, and
- The invoice is paid as issued.
In the event of postponement due to severe adverse weather we reserve the right to substitute the trainer and move the date to a mutually convenient date.
AUDIO/VIDEO RECORDINGS
You are not permitted to make any recordings (audio or video) of Pivotal trainers providing INSET. If you have a good reason why you need to make a recording, please speak to Ellie or Paul in the Pivotal office well in advance of the training day to discuss the issue.
COMPLAINTS
If you have a complaint about any of our products or services, the first step is to contact Ellie (ellie@pivotaleducation.com or 0207 0001735) who will take steps to immediately resolve the problem. If you are not satisfied with the outcome, then you can request a telephone meeting with the managing director, Paul Dix. We take pride in our customer service and take any complaints very seriously.
LAW AND JURISDICTION
Any contract made between us and our clients is governed by and has to be interpreted under English Law and such contract will be subject to the non-exclusive jurisdiction of the English courts.
